The Government Ordinance which modifies the public procurement procedures was approved

The Romanian Government modified the Ordinance no 34/2006, which regulates public procurement. The public authorities will be able to make direct procurements (without auction, without request for bids) for goods, services and construction works whose values are below 10.000 Euro.
Other modifications are as follows:

  • The amounts for which the procedure of request for bids was approved were increased. Thus, price ceiling for goods and services was increased from 40.000 to 75.000 Euro and for works increased from 250.000 to 500.000 Euro;
  • black list companies (companies which broke agreement obligations  following a successful application at an auction during the last  2 years) will not be admitted at the auction;
  • The period for organization of the auction, in electronic systems, reduced from 52 to 24 days;
  • The term for solving appeals is 30 days, and the companies which contest auctions without due justification will be fined;

"Contracted authority will agree on a guarantee that contestors will have to pay. Should the authority find the appeal unjustified, they will retain the guarantee. Of course, the company has the right to challenge the decision of the authority  in justice", explained Prime Minister Tariceanu.
